Terms of Service
Terms and conditions for using KindWatch.
Effective date: February 16, 2026
These terms govern your use of the KindWatch website (kind.watch) and the KindWatch Android application. By using our services, you agree to these terms. You must be at least 18 years old to create a guardian account.
The Service
KindWatch is a family safety and check-in service designed to help adult guardians stay informed about the well-being of aging parents or other vulnerable family members. The service includes:
- Check-in reminders and tracking
- Notification pattern analysis for scam detection
- Weekly AI-generated safety reports
- Emergency contact alerts for missed check-ins
What KindWatch Is NOT
- Not an emergency service. KindWatch does not replace 911 or medical alert systems. If you believe someone is in immediate danger, call emergency services.
- Not a medical device. KindWatch does not diagnose, treat, or monitor medical conditions.
- Not a guarantee of safety. We do our best to detect missed check-ins and suspicious patterns, but no system is perfect. KindWatch is one layer of a broader care strategy.
Monitoring Disclosure
KindWatch is classified as a monitoring tool. This means:
- The app displays a persistent notification on the monitored device at all times, clearly showing that KindWatch is active.
- Before any data is collected, the monitored user must review and accept a prominent in-app disclosure explaining what data is collected, how it is used, and who can see it.
- Google Play Protect may display an additional notification on the monitored device indicating a monitoring app is installed. This is normal and expected.
- The monitored user can uninstall the app at any time to immediately stop all data collection.
Your Responsibilities
- Consent. You must have your family member’s knowledge and consent before installing KindWatch on their phone. The monitored person must review and accept the in-app disclosure, be aware the app is running, and understand what it does. This is both an ethical requirement and a legal one.
- Right to remove. The monitored family member may uninstall the app at any time. You must not prevent, discourage, or retaliate against their decision to do so.
- Accurate information. You agree to provide accurate contact information for emergency contacts and check-in schedules.
- Appropriate use. KindWatch is for family caregiving. Do not use it to monitor someone without their consent, for surveillance of non-family members, or for any illegal purpose.
Accounts & Access
- One guardian account can manage one or more devices
- Device API keys are unique and should be kept confidential
- We reserve the right to suspend accounts that violate these terms
Free Tier
The current free tier includes:
- Up to 3 check-in schedules per device per day
- Weekly AI safety reports
- Emergency contact SMS alerts (subject to Twilio availability)
We may introduce paid tiers in the future. Existing free features will remain available — we won’t bait-and-switch.
Availability & Reliability
- We target high uptime but do not guarantee 100% availability
- Check-in evaluation runs every 5 minutes; alerts may be delayed by up to 10 minutes
- The Android app depends on the phone’s battery optimization settings; we provide guidance but cannot override manufacturer restrictions
- SMS alerts depend on Twilio and carrier delivery; we cannot guarantee delivery
AI-Generated Reports
Weekly safety reports are generated using artificial intelligence. We may use AI providers such as Anthropic, Google, or OpenAI to analyze patterns in call and notification data and flag potential scam activity. AI-generated reports are informational only — they may contain inaccuracies and should not be the sole basis for decisions about your family member’s safety. Always verify concerning findings directly.
Privacy
Your use of KindWatch is also governed by our Privacy Policy, which describes in detail what data we collect, how we use it, and who can access it. By using KindWatch, you agree to both these Terms and the Privacy Policy.
Cookies & Website Analytics
The kind.watch website uses Google Analytics and Google Ads conversion tracking to measure site usage and advertising effectiveness. Analytics cookies are set when you visit the site. Ad storage and ad personalization are denied by default — we do not use advertising cookies or build ad profiles. See our Privacy Policy for full details.
Google Profile Photo
When a guardian signs in with Google, we store their profile name and photo URL. This photo may be displayed on the monitored device’s notifications so the elderly user can see who is looking out for them. The photo is cached locally on the device and is deleted when the guardian is disconnected. By signing in with Google, you consent to your profile photo being used in this way.
Intellectual Property
The KindWatch name, logo, website, and application are our property. You may not copy, modify, or redistribute them.
Content you submit (waitlist messages, feedback) remains yours, but you grant us permission to use it for product improvement.
Limitation of Liability
To the maximum extent permitted by law, KindWatch is provided “as is” without warranties of any kind. We are not liable for:
- Missed alerts or delayed notifications
- Actions taken (or not taken) based on KindWatch reports
- Any damages arising from use of the service
This is especially important: KindWatch is a supplementary tool, not a replacement for direct care and communication with your family.
Termination
You can stop using KindWatch at any time by uninstalling the app and requesting account deletion at hello@kind.watch. Upon account deletion, all personal data will be permanently removed within 30 days, consistent with our Privacy Policy.
We can terminate accounts that violate these terms with reasonable notice. In cases of serious misuse (e.g., non-consensual monitoring), we may suspend access immediately.
Changes to These Terms
We may update these terms as the product evolves. Material changes will be communicated by email at least 14 days before they take effect. Continued use after changes constitutes acceptance.
Governing Law
These terms are governed by the laws of the State of California, United States.
